Requirements:
Goal: Introducing the participants of master vocational studies to the principles and basic legal institutes regarding the registration of real estate rights. Analysis of positive legal solutions important for the registration of real estate rights, and the practice of courts and administrative bodies responsible for registration.
Outcome: Knowledge of legal norms and procedures regarding the registration of real estate rights. Knowledge of court practice and the work of administrative bodies responsible for this area.
Contents of the course
Theoretical instruction:
  1. The concept of book rights, basis and method of acquisition
  2. The concept and significance of the real estate register
  3. Principles of registration of real estate rights: principle of publicity, principle of trust, principle of legality, principle of priority, principle of obligation to register
  4. Composition of the real estate register
  5. Composition of real estate list
  6. Requirements for registration of real estate rights
  7. Form and content of the act of the competent authority, or the document on the legal transaction on the basis of which the registration is made
  8. Types of registration in the real estate register
  9. Registration: property, co-ownership, joint and condominium property, mortgage, real easements
  10. Pre-registration as Requirement registration and justification of pre-registration
  11. Registration of minors, guardianship, deprivation of legal capacity; record of the dispute, record of the prohibition of alienation and security, record of the initiation of the enforcement procedure
  12. Decision allowing enrollment
  13. Decision rejecting enrollment
  14. Appeal against the decision allowing registration
  15. Appeal against the decision refusing enrollment
  16. Deletion of cargo and restrictions
  17. Lawsuit for deletion of entry (erasure lawsuit)
  18. Exposure to public inspection of land survey and cadastral classification data and determination of real estate rights
